These Terms of Service ("Terms") govern your access to and use of the Quizzly Brand Lift Studies platform (the "Service"), operated by VUUKLE LTD ("Quizzly", "we", "us"). By creating an account, purchasing a pack, or using the Service, you agree to these Terms on behalf of yourself and the organisation you represent ("you").
The Service lets you create Brand Lift Studies, generate survey creative tags for delivery on third-party demand-side platforms ("DSPs"), collect anonymous survey responses, and view exposed-vs-control lift analytics. You are responsible for trafficking tags on your own DSPs and for your own media spend, which is billed separately by your DSP and is not part of the fees payable to us.
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You may not share access, attempt to access other customers' data, or use the Service to collect personal data you are not authorised to collect.
You agree not to: use the Service for unlawful purposes; survey or target individuals under the legal age for the product being advertised; collect special-category personal data without a lawful basis; interfere with or attempt to breach the Service; or resell the Service without our written consent. Studies advertising age-restricted products (including tobacco or nicotine products) must comply with all applicable advertising and audience-restriction laws in the target market.
Survey responses collected through the Service are anonymous and do not include names or full IP addresses; IP addresses are masked at collection. Our handling of data is described in our Privacy Policy. You retain ownership of your study configuration and the aggregated results; you grant us a limited licence to process response data to provide the Service. Our data processing terms are set out in the Privacy Policy (see Security and the Data Processing section).
Data processing. Where we process personal data on your behalf, we act as a processor and you as controller. We use the subprocessors listed in the Privacy Policy (currently Google Cloud/Firebase, Cloudflare, and Stripe) and apply appropriate technical and organisational measures.
We aim to keep the Service available but do not warrant uninterrupted or error-free operation. Analytics, including lift and significance figures, are provided for informational purposes; you are responsible for how you interpret and act on them. The Service is provided "as is" to the fullest extent permitted by law.
To the maximum extent permitted by law, VUUKLE LTD will not be liable for indirect or consequential loss, loss of profits, or loss of data. Our total aggregate liability arising out of the Service is limited to the fees you paid for the pack giving rise to the claim.
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. Completed studies and their data remain subject to the Privacy Policy retention terms.
We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the jurisdiction of VUUKLE LTD's registration, to be confirmed on finalisation. Questions: hello@quizzly.ai.
